Chapter 5.92 Mobile Vending
Section 5.92.070 Denial of Permit
All conditions of Section 9.52.060 must be met before the vender or operator
permit is issued.
Written notice of denial will be provided by the City of Tulare and will indicate grounds for
denial. Notice of denial shall be deemed served on the date of personal service or when the
notice is deposited in the United States mail, postage prepaid, and addressed to the applicant at
his or her address as set forth in the permit application.
Any applicant whose application for a vendors or operators permit
has been denied by the
City of Tulare may appeal such denial to the City Manager by filing a written notice of appeal
with the City Managers office no later than ten (10) days following service of this notice of
the
decision. Notice of appeal must be accompanied by the appeal fee and is deemed filed with the
City on the date of receipt by the City of Tulare. The appeal fee shall be set by resolution of the
City Council.
No person or entity whose permit request is denied on appeal shall be eligible
to re-apply for a
period of one year from the date of the denial of his/her permit request.
