Chapter 6.16 DOGS; CONTROL OF ANIMALS
Section 6.16.070 Violations.
(A) Any person violating any of the provisions of sections 4-07-1265 of said
chapter 7 of the
Tulare County Ordinance Code shall be guilty of a misdemeanor and shall be punished by a fine
of not more than five hundred dollars ($500.00) or by imprisonment in the County jail for not
more than six (6) months, or by both such fine and imprisonment.
(B) Any person violating any of the provisions of section 4-07-1135 of said
chapter 7 of the
Tulare County Ordinance Code shall be guilty of an infraction and shall be punished upon a first
conviction by a fine of not less than ten dollars ($10.00) and not exceeding fifty dollars ($50.00)
and for a second conviction within a period of one year by a fine of not less than ten dollars
($10.00) and not exceeding one hundred dollars ($100.00) and for a third or any subsequent
conviction within one year by a fine of not less than ten dollars ($10.00) and not exceeding two
hundred fifty dollars ($250.00).
(C) Any person violating any of the provisions of section 4-07-1275 of said
chapter 7 of the
Tulare County Ordinance Code shall be guilty of an infraction and shall be punished upon a first
conviction by a fine of twenty five dollars ($25.00), and for a second conviction within a period
of one year by a fine of fifty dollars ($50.00), and for a third or any subsequent conviction within
one year by a fine of one hundred dollars ($100.00).
(D) In any case wherein an animal attacks a human being or another animal, then
such act shall
constitute a separate and distinct offense and violation, and shall be punishable as follows:
1. Any person whose animal attacks
a human being without causing bodily injury, or
attacks another animal, shall be guilty of an infraction and shall be punished upon a first
conviction by a fine of one hundred dollars ($100.00), and for a second conviction within a
period of one year by a fine of two hundred dollars ($200.00), and for a third or any subsequent
conviction within one year, by a fine of three hundred dollars ($300.00).
2. Any person whose animal attacks
a human being causing bodily injury shall be guilty of
a misdemeanor and shall be punished by a fine of not more than five hundred dollars ($500.00)
or by imprisonment in the County jail for not more than six (6) months, or by both such fine and
imprisonment.
(E) Any person violating any of the provisions of this Chapter or of said chapter
7 of the
Tulare County Ordinance Code, other than as specified hereinabove, shall be guilty of an
infraction and shall be punished upon a first conviction by a fine of fifty dollars ($50.00), and for
a second conviction of the same provision within a period of one year by a fine of one hundred
dollars ($100.00), and for a third or any subsequent conviction of the same provision within a
period of one year by a fine of two hundred fifty dollars ($250.00). (Ord 98-1830 § 1 (part): Prior
