IX. CITIZEN COMMENTS
This is the time for citizens to comment on subject matters, not on the agenda within the jurisdiction of the Tulare City Council. The Council Members ask that you keep your comments brief and positive. Creative criticism, presented with appropriate courtesy, is welcome. The Council cannot legally discuss or take official action on citizen request items that are introduced tonight.
This is also the time for citizens to comment on items listed under the Consent Calendar or to request an item from the Consent Calendar be pulled for discussion purposes. Comments related to general business/city manger items or public hearing items will be heard at the time the item is discussed or at the time the Public Hearing is opened for comment.
In fairness to all who wish to speak, each speaker will be allowed three minutes, with a maximum time of 15 minutes per item, unless otherwise extended by Council. Please begin your comments by stating and spelling your name and providing your city of residence.
X. COMMUNICATIONS
Communications are to be submitted to the City Manager’s Office 10 days prior to a Council Meeting to be considered for this section of the Agenda. No action will be taken on matters listed under communications; however, the Council may direct staff to schedule issues raised during communications for a future agenda. Citizen comments will be limited to three minutes, per topic, unless otherwise extended by Council.
XI. CONSENT CALENDAR
All Consent Calendar Items are considered routine and will be enacted in one motion. There will be no separate discussion of these matters unless a request is made, in which event the item will be removed from the Consent Calendar to be discussed and voted upon by a separate motion.
(1) Approve minutes of January 19, 2010 regular meeting(s).
(2) Accept December Investment Report.
(3) Approve and adopt the City of Tulare 2010 Statement of Investment Policy.
(4) Authorization to reduce the accounting fee charged to Tulare Youth Service Bureau (YSB) to $3,200 a month starting January 1, 2010.
(5) Adopt Resolution 10-09 authorizing an additional appropriation of funds for a special purpose.
(6) Presentation and acceptance of the City’s and Redevelopment Agency’s annual audited financial statements. (Copies of the CAFR are available for viewing at the City Clerk’s Office.)
(7) Final acceptance of public works improvements for Parcel Map No. 4972, located at the northwest corner of Corvina Avenue and Hillman Street.
(8) Reject claim for damages from Taneisha Ann Handsbur.
(9) Authorization for the City Manager to execute a First Amendment to the Memorandum of Understanding by and between the City of Tulare, Family Services, and the Housing Authority of Tulare County, dated January 13, 2010, originally approved to implement the $185,100 grant from the US Department of Housing and Urban Development, to provide five (5) Shelter plus Care vouchers for chronically homeless; Authorization for the City Manager to sign the Amendment on behalf of the City in substantially the form attached; and Authorization for the City Attorney to make minor and/or technical changes to the Agreement.
(10) Consider approval of a Conveyance and Cooperation Agreement between the City of Tulare and Tulare Redevelopment Agency, for the proposed development of the City owned public library, located at 113 N. F Street, for an amount equal to ONE DOLLAR ($1.00); Authorize the City Manager to sign the Agreement on behalf of the City in substantially the form attached; Authorize the City Attorney to make minor and/or technical changes to the Agreement.

Comments related to Public Hearing Items are limited to three minutes per speaker, for a maximum of 30 minutes per item, unless otherwise extended by the Council.
(1) Public Hearing:
a. Public Hearing to adopt Resolution 10-10 for the vacation of a pedestrian way easement across the Town and Country Park Unit No. 1 subdivision located between Gem Street and The Village Shopping Center.
b. Public Hearing to Pass-to-Print Ordinance 10-02 amending and revising municipal code section 10.180 (Vendor Stands on Private Property).
c. Public Hearing to Pass-to-Print Ordinance 10-03 amending and revising municipal code section 10.184 (Outdoor Sales of Merchandise)
d. Public Hearing to Pass-to-Print Ordinance 10-04 amending municipal code section 1.64.040 (Schedule of Fees and Service Charges).
(2) City Manager:
a. State and Local Budget Update.
b. Request for direction regarding temporary off-site automobile sales.
c. Assembly Bill 811 (AB811) program update and direction regarding participation.
